HostMoose is a service operated by BrenCor Digital Enterprises Inc.

Data Processing Addendum (DPA)

This Data Processing Addendum ("DPA") forms part of the agreement between BrenCor Digital Enterprises Inc. ("BrenCor," "Processor") and the customer ("Controller," "you") regarding the use of HostMoose ("HostMoose," "the Service").

1. Role of the Parties

For personal data that you store or process using HostMoose, you act as the Data Controller and BrenCor acts as the Data Processor.

2. Subject Matter and Duration

This DPA governs BrenCor's processing of personal data on your behalf for the duration of your use of HostMoose, or until the underlying agreement is terminated and data is deleted or returned.

3. Nature and Purpose of Processing

BrenCor processes personal data solely to provide hosting, storage, backup, and related technical services via HostMoose, as described in our Terms & Conditions and Privacy Policy.

4. Types of Personal Data and Data Subjects

The types of personal data and categories of data subjects depend on how you use HostMoose and what data you choose to store or process on the platform (for example, your website visitors, customers, or users).

5. Processor Obligations

BrenCor agrees to:

  • Process personal data only on documented instructions from you
  • Implement appropriate technical and organizational security measures
  • Ensure personnel with access to personal data are bound by confidentiality obligations
  • Assist you with data subject requests where feasible
  • Notify you without undue delay of data breaches affecting personal data

6. Sub-processors

BrenCor may use sub-processors (such as data centres, infrastructure providers, and support tools) to deliver HostMoose. We ensure sub-processors are bound by data protection obligations consistent with this DPA.

7. International Data Transfers

Where personal data is transferred across borders, BrenCor will use appropriate safeguards in accordance with applicable data protection laws.

8. Data Subject Requests

You are responsible for handling requests from your own data subjects. BrenCor will provide reasonable assistance where feasible, taking into account the nature of the processing.

9. Data Breach Notification

In the event of a personal data breach affecting HostMoose systems that process your data, BrenCor will notify you without undue delay after becoming aware of the breach and will provide information reasonably required for you to meet your legal obligations.

10. Return or Deletion of Data

Upon termination of your HostMoose account or at your written request, BrenCor will delete or return personal data stored as part of the Service, unless retention is required by law or legitimate business needs (such as security logging).

11. Priority

In the event of a conflict between this DPA and the main Terms & Conditions, this DPA will control with respect to data protection obligations.
