These Terms & Conditions ("Terms") form a binding agreement between BrenCor Digital Enterprises Inc. ("BrenCor," "we," "our," "us") and you ("Customer," "you"). HostMoose ("HostMoose," "the Service") is a hosting and website management service operated by BrenCor.
By using HostMoose, you agree to these Terms. If you do not agree, do not use the Service.
Service Scope and Branding
BrenCor Digital Enterprises Inc. offers multiple services under different brand names, including HostMoose and MooseMailer. These services may share infrastructure, systems, and data where necessary to operate and support the services you use.
Your use of any BrenCor service is subject to the applicable Terms for that service, together with any shared platform policies.
1. Services Provided
BrenCor provides the HostMoose hosting services, which may include:
- Shared and managed hosting
- Website migrations
- Domain registration and DNS management
- SSL certificates
- Website monitoring and performance optimization
- Email hosting where available
- Managed care plans
- Technical support
Specific services and features depend on the plan you select.
2. Account Responsibilities
You agree to:
- Provide accurate and up-to-date account information
- Maintain the confidentiality of your login credentials
- Use strong, unique passwords
- Notify BrenCor immediately of any unauthorized account access
You are responsible for all activity that occurs under your account.
3. Acceptable Use Policy
You must not use HostMoose to:
- Host or distribute malware, viruses, trojans, or malicious code
- Conduct phishing, spam, or deceptive practices
- Host illegal content or infringe intellectual property rights
- Host adult content unless explicitly permitted by your plan
- Mine cryptocurrency on shared hosting infrastructure
- Consume excessive resources that impact other customers
- Attempt unauthorized access to systems or data
- Engage in any activity prohibited by applicable law
BrenCor reserves the right to suspend or terminate Service, with or without notice, in cases of suspected violations of this Acceptable Use Policy.
4. Payments & Billing
- Fees for HostMoose plans are due at the start of each billing cycle.
- Some services may renew automatically unless you disable auto-renewal in your account or notify us before renewal.
- You agree to maintain valid payment details on file.
- Missed or failed payments may result in suspension or termination of Service.
- Taxes may apply depending on your billing location.
5. Refund Policy
We offer a 30-day refund period on new HostMoose hosting plans, including monthly and annual plans. To qualify, refund requests must be submitted within 30 days of the initial purchase date.
After 30 days, all hosting fees are non-refundable, including any unused portion of an annual plan.
The following items are non-refundable:
- Domain name registrations and renewals
- SSL certificates
- Third-party services or add-ons
- Custom technical work, migrations, or hands-on labour
- Late fees or service reactivation fees
If a refund is approved, we will close your account and terminate associated services at the time of refund.
6. Website Content Ownership
You retain full ownership of all content you host with HostMoose. You are solely responsible for ensuring that your content complies with applicable laws and does not infringe the rights of others.
You grant BrenCor a limited license to store, back up, and transmit your content solely for the purpose of delivering the HostMoose Service.
7. Backups & Data Loss
If backups are included in your plan, BrenCor will perform automated backups on a regular schedule and may assist with restores on a best-effort basis.
You are responsible for maintaining your own independent backups. BrenCor is not liable for data loss, data corruption, or business interruption resulting from use of the Service.
8. Service Availability
BrenCor aims to provide reliable uptime for HostMoose but does not guarantee uninterrupted or error-free Service. Scheduled maintenance, emergency work, or events beyond our control may affect availability.
9. Managed Services (If Purchased)
If you subscribe to a managed care or maintenance plan, BrenCor may perform tasks such as software updates, security hardening, malware scanning, cleanup, and performance optimization on your website.
You agree to provide the necessary access (e.g., admin logins, SFTP, database access) for us to deliver these services.
10. Termination
BrenCor may suspend or terminate your access to HostMoose if:
- Payments are overdue
- You violate these Terms or our Acceptable Use Policy
- Your account poses a security or legal risk
- We are required to do so by law or regulation
You may cancel your plan at any time via your account dashboard or by contacting support. Upon termination, we may delete files, databases, and backups associated with your account.
11. Limitation of Liability
To the maximum extent permitted by law, BrenCor is not liable for any indirect, incidental, consequential, or special damages, including loss of revenue, profits, data, or business opportunities.
BrenCor's total liability for any claims arising out of or related to the Service is limited to the fees you paid for HostMoose during the 12 months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless BrenCor from any claims, damages, liabilities, and expenses arising from:
- Your website content
- Your use of HostMoose
- Your violation of these Terms
- Any third-party claims related to your content or activities
13. Security Vulnerability Reporting
If you discover a security vulnerability in HostMoose or any BrenCor service, please report it responsibly to security@hostmoose.ca. We appreciate your help in keeping our platform secure.
We do not offer a bug bounty program at this time, but we will acknowledge valid reports and work to address confirmed vulnerabilities promptly.
14. Modifications to Terms
BrenCor may update these Terms from time to time. We will post the revised Terms with an updated "Last Updated" date. Your continued use of HostMoose after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law
These Terms are governed by the laws applicable in the jurisdiction where BrenCor is incorporated, together with any applicable federal laws, without regard to conflict-of-law principles.
